DERBY, CT — A Superior Court judge has upheld an arbitration award requiring the city of Derby to factor overtime earnings into workers’ compensation benefits for a police officer involved in a 2021 shooting.
In a decision issued last week in state Superior Court in Milford, Judge Walter M. Spader Jr. rejected a bid to overturn a unanimous arbitration award that found the city of Derby violated its police union contract by excluding overtime earnings from supplemental workers’ compensation payments to Patrick Foley.
